Foreclosure Help using HAMP

If your income has dropped significantly (but you still have an income), you might qualify for a HAMP loan modification program. To qualify for HAMP, your previous income to mortgage payment have to be above 31%. If your lender qualifies for HAMP (ie. If they can prove they own the loan or the right to service the loan), then you might be able to get government assistance through HAMP in which the government will reduce the principle value of your loan such that your monthly payments will equal to 31% of your monthly take home income.

Sadly, the truth is less than 3% of people who apply for a loan modification actually get it.

Very few servicer actually go through HAMP even though the money is set aside because these loans have been securitized (meaning they are sold onto Wall St as Mortgage Backed Securities). Servicers can not prove that they own the loan nor the right to service the loan. This is the dirty little secret your lender don’t want you to know. Foreclosure Help using Non-HAMP Loan Modification

Since most loans have been securitized, most lenders choose not to participate in the HAMP program, and offer their own “loan modification” as a means to help homeowners facing foreclosure.

The reality is, very few actual loan modifications are given. Lenders often represent that they have both the ability and authority to modify a loan. The reality is, they do not. The dirty little secret is, since your loan has been securitized, they are sold on a fixed term to investors on Wall Street. Once the loan is sold on Wall St, these terms can not be changed.
