Q) What’s the name of the law firm? Can I call them up directly?
A) Through a special arrangement, the firms have asked us not to give out their information for specific legal compliance reasons. They have asked that clients first fill out the questionnaire form and the firm will then contact the homeowner directly. Our people will then qualify the client to see if they should be referred to one of the Law Firms. Many people fill out the questionnaires just looking for a free consultation, and that is not what we are about. We want to make sure that everyone that fills out a questionnaire is serious about their case and has the funds to retain an attorney if it is found that they have a sustainable case.
If every one from this site start calling the attorney firm, they will not have any time to do their work.
Q) Can This Law Firm do “pro bono” work? I don’t have any money. I have a really good case and will likely receive a large settlement on the back?
A) Unfortunately this is not possible. Our attorneys have made a commitment to making foreclosure defense as affordable as possible to as many homeowners as possible. However, at the end of the day, they have kids to feed and mortgages to upkeep too. Almost everyone in this situation is asking for pro bono work…and there are simply so many homeowners needing help and not enough attorneys to do the work, so the demand for their services is very high.
Q) What sort of successes has this firm had?
A) The firm have had a lot of success in most cases in stopping foreclosure sales, getting home loan modification settlement offers and other remedies. However, as each client’s situation is different, it is almost impossible to say up front what sort of success you can expect until you speak with the attorney. Remember, you don’t pay anything until you get to speak with the attorney so there’s very little risk on your part.
Q) Can this Law Firm offer any guarantees that I can keep my home?

I live in CA. Been attempting to modify my loan since Dec 2010 with BofA. Already “updated” my MHA mod application twice. I’m constantly getting contrary information from their rep’s. Talked with Brookstone. They seem more like a boiler room operation. They have initial screeners with 800 numbers who instill a sense of urgency. They say an attorney will review your documents. Then they have you talk with a “banking representative” instead of an attorney. He hits you up for a securitization audit that will only go forward if it can be of use. In the case it is not of use, they will refund all but $350. Seems fair. But, when the written agreement arrives, it does not contain that language! I called them on that and he wouldn’t send me another written agreement with the terms he verbally committed to. And, I’ve never actually spoke with one of their attorney’s. They actually returned my loan doc’s without me asking for them. I guess that’s what I get for asking too many questions! I’ve already received a NOD and a Notice of Sale Date (July 26). I finally got BofA to actually review my MHA mod application. They stated they would automatically issue a postponement of the Sale Date AND communicate that with the Foreclosure Admin company (Quality Loan Serving, San Diego). I do not believe them as almost everything BofA has ever said to me has proven to be false. I keep a written activity log for my records. I’m even working with a 3rd party counseling service (CredAbility) whom BofA routinely ignores. These folks are useless anyway providing very little, if any, added value! Now, with my sale date fast approaching and a mod application still in review, I’m going to seek Ch 13 protection and get this thing into the court system where I’ll be on more even footing with the bank…unless BofA gets real smart real fast and decides to reasonably negotiate a solution with me as my default, while strongly influenced by unemployment, is more strategic in nature. I modeled this investment in my home and discovered that I’ll be in this house almost 20-years before a break-even…lost 60% of the 2006 FMV. Ouch! Fortunately, based upon good budgetary planning, I have the money to settle…or hire lawyers.

Mitch doesn’t get it. I have talked with Mitch. Rickie’s case has not been won. There is a chance Rickie may win, but it is still ongoing. Mitch doesn’t care that the banks have been paid by the insurance carried for default. He thinks that all you want is your house for free. Also, unless you have income, chapter 13 won’t fly. No adversary pleading then either. You need a job or sufficient income to restructure under chapter 13

I am in Washington State and have started this process. I will need some legal help here in Washington State to go after Chase and stop my foreclosure. Chase finally replied to my first two letters 5 months later. They suggested that I get a lawyer. Someone came by my home yesterday and took pictures of the house and left a note on my door to call Chase.

Hi, I have been fighting for my home since January 2008.The lawyer represented both buyer and seller,and notarized documents as well.He never told me there were back taxes added to my mortgage,until I received the bill from the County.I went to the County to make arrangement to pay the back taxes,but they wouldn’t accept my money because I had no proof the home was mine.The deed wasn’t filed until nine months after I signed the mortgage papers.I have been trying to figure out who holds the mortgage on my home ever since.I’ve spent numerous amounts of time and money trying to resolve this,but nobody wants to help.I have been to foreclosure hearings in court,and still nobody wants to hear the truth.They are only focused on the foreclosure.I do not know who to pay,First Franklin,Lasalle Bank,Home Loan Services,Bank of America,or Merril Lynch.Here is the good part! I have been mortgage free for over 3 years now,and haven’t paid a dime to any of these thieves.The Court wants my legal aid advisor and I to submit another modification application and try to work things out.My next hearing is May 25th in Cortland,N.Y.I asked my appointed Attorney if we can sue everyone,but she said she can only focus on the foreclosure.She knows everything that’s happened,and still ignores the fraud that has taken place.I am ready to go to the media with this,and stand up for the hard working people of America.I need someone to hear my story,and help me take this to court.I have complaints and cases established with th Attorney General,office of the Comptroller of Currency,and office of Thrift Supervision.Please let me know what I can do to take legal action in this situation.Thank you,Gary

What many homeowners are forced to do when faced with a situation like yours is to sue their lender. It’s the only thing that will get them to pay attention. Of course, this is not something you should do lightly…you do, or you do not…there’s no half way.

My encounters with Lawyers in CT has been that they seem to follow the process, understanding the “mistakes the lenders made in the paperwork” but most are sympothetic of the lenders! Not one I spoke to will even Guide me pro se throught the basic court filing process. It seems to me that in my situation the lawyers are afraid to be associated with any homeowner who wishes to “quiet title” against these bankers!
they definately dont get how the securitization process disolves the “note”. Unless someone knows of a lawyer here in CT I’ll be muddling through the court process alone.

Here is a link to a program you can buy for $250 that will teach you how to not only go through basic court filings, but to win in court and make the judge do what you want him to do. It is all in what you know. This was written by an attorney who says that once you learn this, you will know more than most attorneys out there. Good Luck!

I’ve searched every where for an Attorney and nothing. I’ve got one and a half months before the server forecloses on my home. I just received a Notice of Hearing for May 3, 2011 and I have to respond by April 28, 2011 and I don’ know what to do.
Hi John, I too tried Stephen Brunette and he couldn’t help me either. I have worked with Doug Johnson, but I still haven’t found an Attorney. Everything I read say’s that not to take this on by your self.

Chase is only a servicer, I would like to keep my home! I am sick of this, how come that the government allows wrongful foreclosures. I can not belive that they do not know what goes on behind the scenes!

My attorney just told me that about a month ago, Chase agreed with the government to make a one time adjustment of $8 billion and help modify people with the old Pick a Payment loan from WaMu. The way to take advantage of this is to apply for a loan modification. Do it quick though. Chase has only agreed to $8 billion. Once that money is gone, they are not interested in helping you out. At least, not as long as the can get $20k to $40k profit from every foreclosure they illegally do.

I meet face to face with the attorney Mitch Abdullah list above. He gave me the impression that he was very sharp. But he didn’t seam to be very interested in helping me without giving him a significant amount of money up front and very little hope of prevailing.

I found a team of lawyers in LA that specializes in real estate litigation. Their website is http://www.brookstone-law.com. They are in the middle of a mass joiner cases against Bank of America, in which BofA has already admitted to their fraud. They will be opening mass joiner cases against Chase and Wells Fargo no later than 1st or 2nd week of April 2011. Apparently, the evidence against Chase’s is far more damning that what was presented for BofA. I’ve been working with them for the past couple of weeks regarding my mortgages. So far, they are really sharp and very thorough. They also have a department that is successful in delaying most foreclosure sales. They just delayed the sale on one of my properties that was scheduled for next week. They are primarily for California, but they have been talking and helping in other states. I just don’t know how much.

I meant to say my NOD (Notice of Default) and BofA is “reviewing” my modification application. This is about the 5th application in 9 months. Lost my job April 2010 and have been trying to remod my 1st w/ BofA and my 2nd with Citimortgage. NIGHTMARE. Please HELP.

One of our members sued BofA for this exact reason. Frankly, the reason why they won’t/can’t give you the loan mod is because they are not the owner of the note. This is known as fraudulent misrepresentation. Try writing to them to have them stipulate for the record whether they have the authority to do the loan mod. You could use this stalling tactic (the fact that this is the 5th time in 9 months) as your cause of action for your civil action.

Hi Joe, what part of ILL. are you from? Right now I’m holding off the banker with a loan modification. It has been 18 months now. Then I got this email from a friend and read the whole thing. I joined the program in hopes of finding an attorney here in ILL. I think what you should have done is put all your apples in a row. So your prepared to counter the banks every more. Court rooms intimidate me so I’m trying to find a lawyer. I might have one, but he is on vacation for the next to weeks. If I find one that understands what it is were doing I let you know.
