Preparing The Second Letter

In this module, we want to have our second letter to the bank ready so when they send you that photocopy, you will be ready to rebuke them and reject their offer.

As per my previous homework/module, you should have all your information compiled in your “000-Things to Gather” document. If you have not gotten all these information gathered by now, be sure to get it completed asap.

You want to go down to the County Deeds and Records department and get copies of your first couple of pages of each of your Deeds of Trust (if you have more than one).

Next, simply open the following document: 003-Second-Letter to Lender.doc

Now, simply edit this document with your information. Have this ready so that the day you receive the photocopy, you can immediately send the rebuke and give them 14 days.

You will likely get some BS letter response from your lender. It will have some thing like:

“We find the statemens made in your letter to be completely without merit and do not assert any right you have under state or federal law. GMAC Mortgage, LLC has no record of a specific, bona fide, good faith dispute being raise by you.

We encourge you to discontinue sending letters expressing legally baseless claims. Any further correspondence received which is similar to that which was resently sent will be met with no response and GMAC will continue to show the loan as outstanding.”

Just ignore it and continue with the process. This is their standard form letter that their minimum wage employee pumps out. It doesn’t even have a signature or name…they are hoping that you would just shut up and go away.

Californians! There are extra Goodies for You

In the /Documents, you should find a folder called “California Specifics”.  There are a number of additional procedures and Cvil code violations that you should know about.  These have been contributed to other people in the program.

You should take a moment to review these.  They are very powerful.

Action Items

1) Customize the second letter 003-Second-Letter to Lender.doc and wait for your lender to send you a bogus response.  Once you receive it, fire off the second letter, certified mail/return receipt.

2) Also, if you haven’t done so, sign up for Prepaid legal.  This is really important.  DO IT!!!!!

It really angers me when I get people who calls me and say “their lawyer sent me this letter, what do I do now?”

I DON’T KNOW!!! I can’t give you legal advice.  For $16, it is so awesome that you can just pick up the phone and talk to a lawyer and ask them “what do I do now?”

Some people are trying to save money and say to themselves..”maybe we don’t need legal help.  We’ll wing it.  Vince seems to know what he’s doing.  We’ll rely on him.”

If you are one of these people, then I want you to email me. I will refund your money and kick you out of the program.  I do not have time for people who are penny wise and pound foolish.  If you lose your home because of bad legal advice or mistakes…then you deserve it.

If you call me seeking legal advice and court procedures and I find out you don’t have prepaid legal, I will hang up the phone on you.  I am not your mother.
